By browsing, accessing or using the Platform or any Services (as defined below) available through it, you hereby indicate that you agree and accept to these Terms and Conditions and that you agree to abide by them. Your use of any part of the Platform constitutes your acceptance of these Terms and Conditions which takes effect on the date on which you first use the Platform. If you do not agree with these Terms and Conditions, you should cease using the Platform immediately.

Advertisers/Merchants and users are responsible for ensuring that advertising content, text, images, graphics, video (“Content”) uploaded for inclusion on Blithe.lk complies with all applicable laws. Blithe.lk & Blithe (Pvt) Ltd. Holds no responsibility for any illegality or any inaccuracy of the Content.

The advertisers/merchants and user guarantees that his or her Content do not violate any copyright, intellectual property rights or other rights of any person or entity, and agrees to release Blithe.lk & Blithe (Pvt) Ltd from all obligations, liabilities and claims arising in connection with the use of (or the inability to use) the service.

Advertisers/Merchants agree that their Content can may be presented through Blithe.lk’s partner sites under the same terms and conditions as on Blithe.lk.

Copyright

Advertisers grant Blithe.lk & Blithe (Pvt) Ltd a perpetual, royalty-free, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from and distribute such Content or incorporate such Content into any form, medium, or technology now known or later developed.

The material (including the Content, and any other content, software or services) contained on Blithe.lk are the property of Blithe (Pvt) Ltd, its subsidiaries, affiliates and/or third party licensors. Any intellectual property rights, such as copyright, trademarks, service marks, trade names and other distinguishing brands on the Web Site are the property of Blithe (Pvt) Ltd. To be clear: No material on this site may be copied, reproduced, republished, installed, posted, transmitted, stored or distributed without written permission from Blithe (Pvt) Ltd.

Watermarks

Blithe.lk & Blithe (Pvt) Ltd. Holds the right to watermark all the images, which prevents the images to be used for other purposes, without the consent of the advertiser.

Safety and images

Blithe.lk & Blithe (Pvt) Ltd reserves the right to change the title of the Content, for editorial purposes. Blithe.lk & Blithe (Pvt) Ltd reserves the right not to publish images that are irrelevant or images that violate Blithe.lk’s rules.

Personal

Blithe.lk & Blithe (Pvt) Ltd has the right to cooperate with authorities in the case any Content violates the law. The identity of advertisers, users or buyers may be determined, (E.g. by an ISP. IP addresses may also be registered in order to ensure compliance with the terms and conditions).

Privacy

Blithe.lk & Blithe (Pvt) Ltd. will collect information from Users and Advertisers. It is a condition of use of the Blithe.lk that each User and advertiser consents and authorizes Blithe.lk & Blithe (Pvt) Ltd to collect and use this information. Blithe.lk & Blithe (Pvt) Ltd also reserves the right to disclose it to Company Affiliates and any other person for the purposes of administering, supporting, data mining and maintaining Blithe.lk, Also for improving Blithe.lk. (E.g. using the information for research, marketing, product development and planning).

Cookies

Blithe.lk uses cookies in all platforms, which means that you must have cookies enabled on your computer/ mobile devise or any other devise used, in order for all functionality of Blithe.lk to work properly. A cookie is a small data file that is written to your hard drive when you visit certain platforms. Cookie files contain certain information, such as a random number user ID that the platforms assigns to a visitor to track the pages visited. A cookie cannot read data off your hard disk or read cookie files created by other sites. Cookies, by themselves, cannot be used to find out the identity of any user.

Personal details of users

Merchants & users are required to submit a valid email address, contact number/s, Business registration before they are allowed to Sign in & post advertisement and view advertisements. Also, Date of Birth, Identification number & Images of the users are requested optionally and users may fill same upon their discretion. Personal details mentioned above of the User shall not be publicly displayed and other users are permitted to send email to the User through Blithe.lk.

Site availability

Blithe.lk & Blithe (Pvt) Ltd does not guarantee continuous or secure access to the platform/s. The platform/s are provided “as is” and as and when available.

Links to third party websites

Blithe.lk may contain links or references to other websites (‘Third Party Websites’). Blithe.lk & Blithe (Pvt) Ltd shall not be responsible for the contents in Third Party Websites. Third Party Websites are not investigated or monitored. In the event the user decides to leave Blithe.lk and access Third Party Sites, the user does so at his/her own risk.

Paid content and services

Some content and services of Blithe.lk require payment, including but not limited to, membership packages, posting of ads in select categories, and sale of items.

Users may purchase ad promotions using vouchers issued or sold by Blithe.lk. Vouchers may not be redeemed for cash.

Advertisers and Users may be required to transmit Paid Content information through a third-party service provider, which may be governed by its own terms of use. Linking to any third party service providers is at the Users’ and Advertisers’ own risk and Blithe.lk disclaims all liability related thereto. Under no circumstances shall Blithe.lk be obliged to refund any payments made in respect to Paid Content.

Memberships

If and when Blithe.lk initialize a membership package for one or all users (Merchants & Consumers), Blithe.lk will create a Shop on behalf of the user post informing all users through the platform. A Shop will be on Blithe.lk, maintained by Blithe.lk, with content provided by the user. Blithe.lk has the right to any content added to the Shop by the user and has the right to remove or not publish the content if it violates any aspect of the Terms and Conditions.

Blithe.lk will reserve the right to modify or change membership packages, including the price and the contents of the membership package.

Blithe.lk will not be obligated to refund money or services if a membership package is cancelled early, for any reason.

Rules about use of the service and the Platform

Blithe.lk will use reasonable endeavours to correct any errors or omissions as soon as practicable after being notified of them. However, Blithe.lk do not guarantee that the Services or the Platform will be free of faults (or Vouchers will be free of error) and Blithe.lk does not accept liability for any errors or omissions. Blithe.lk does not warrant that your use of the Services or the Platform will be uninterrupted and we do not warrant that any information (or messages) transmitted via the Services or the Platform will be transmitted accurately, reliably, in a timely manner or at all.

Blithe does not warrant you the quality & the service levels of the merchant, Food & beverages or their staff. Also, reviews are feedback of users and they hold responsibility of them. Blithe.lk is only a platform for merchants to advertise their promotions and consumers to view and decide. Selection of the promotion and/or merchant is a sole decision of the consumer.

Blithe.lk does not give any warranty that the Services or the Platform is free from viruses or anything else which may have a harmful effect on any technology.

Blithe.lk will use reasonable efforts to allow uninterrupted access to the Services and the Platform, however Blithe.lk shall not be held liable in the event access to the Services and the Platform may be suspended, restricted or terminated at any time.

Blithe.lk reserve the right to change, modify, substitute, suspend or remove without notice any information or Services or forming part of the Services from time to time. Your access to the Platform and/or the Services may also be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. Blithe.lk will attempt to restore such access as soon as we reasonably can. We assume no responsibility for functionality which is dependent on your browser or other third party software to operate (including, without limitation, RSS feeds). For the avoidance of doubt, we may also withdraw any information or Voucher from the Platform or Service at any time.

Blithe.lk reserves the right to block access to and/or to edit or remove any material which in our reasonable opinion may give rise to a breach of any of these Terms and Conditions.

Blithe.lk reserves the right to suspend, limit or withdraw access to Blithe.lk and/or Membership of any user who does not comply with these terms.

Disclaimer

Blithe.lk & Blithe (Pvt) Ltd. assume no responsibility what so ever for the use of Blithe.lk and disclaims all responsibility for any injury, claim, liability, or damage of any kind resulting from or arising out of or any way related to (a) any errors on Blithe.lk or the Content, including but not limited to technical errors and typographical errors, (b) any third party web sites or content directly or indirectly accessed through links in Blithe.lk, (c) the unavailability of Blithe.lk, (d) your use of Blithe.lk or the Content, or (e) your use of any equipment (or software) in connection with Blithe.lk

Indemnification

Advertisers and users agree to Blithe.lk & Blithe (Pvt) Ltd. as well as its officers, directors, employees, agents, from and against all losses, expenses, damages and costs, including attorney’s fees, resulting from any violation of this Terms and Conditions (including negligent or wrongful conduct).

Modifications

Blithe.lk & Blithe (Pvt) Ltd. reserves the right to modify these Terms and Conditions. Such modifications shall be effective immediately upon posting on Blithe.lk. You are responsible for the reviewing of such modifications. Your continued access or use of Blithe.lk shall be deemed your acceptance of the modified terms and conditions.

Governing law

Blithe.lk & Blithe (Pvt) Ltd. is operated under the laws and regulations of Sri Lanka.
